Welcome to SQUAWK!™ by Beakin Network Developing. By using our app, you agree to these Terms of Service.
1. Acceptance of Terms
By creating an account or using SQUAWK!™, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you do not agree, do not use the app.
2. Eligibility
- You must be 18 years or older to create an account
- Users ages 13–17 may join existing Nests with parental awareness
- Users under 13 require verified parental consent (COPPA compliance)
- You must provide accurate information during registration
3. Account Responsibilities
- You are responsible for maintaining account security
- You must not share your login credentials
- You must notify us immediately of unauthorized access
- You are responsible for all activity under your account
4. Emergency Services Disclaimer
⚠️ SQUAWK!™ IS NOT AN EMERGENCY SERVICE ⚠️
The Beakin alert feature notifies your Nest members only. It does NOT:
- Contact 911 or emergency services
- Dispatch police, fire, or medical responders
- Guarantee message delivery
- Replace professional emergency response
In life-threatening emergencies, ALWAYS call 911 first.
5. Acceptable Use
You agree NOT to:
- Use SQUAWK!™ for illegal purposes
- Harass, threaten, or abuse other users
- Share inappropriate, violent, or explicit content
- Impersonate others or create fake accounts
- Attempt to hack, exploit, or disrupt the service
- Use automated systems or bots
- Abuse the Beakin emergency system with false alerts
- Violate any applicable laws or regulations
6. Virtual Currency
Golden Eggs & Squawk Gems:
- Are virtual in-app currencies with no cash value
- May be earned through gameplay or purchased
- Are non-refundable and non-transferable
- May be modified or removed at our discretion
- Cannot be exchanged for real money (except via NSTG conversion)
7. Cryptocurrency (NSTG)
- NSTG (Nest Egg) is a Solana-based cryptocurrency
- Golden Eggs may be converted to NSTG through The Vault
- You must be 18+ to use cryptocurrency features
- Exchange rates are dynamic and set by Beakin Network
- Transactions are irreversible — verify wallet addresses carefully
- We are not responsible for lost tokens due to user error
- NSTG values may fluctuate; this is not investment advice
- You are responsible for applicable taxes
8. In-App Purchases
- All purchases are final and non-refundable
- Prices may change without notice
- Purchases are tied to your account, not device
- We reserve the right to limit purchase quantities
9. User Content
- You retain ownership of content you create
- You grant us a license to display your content within the app
- You are responsible for content you share
- We may remove content that violates these Terms
- Photos are automatically deleted after 48 hours
10. Intellectual Property
- SQUAWK!™ and all related marks are owned by Beakin Network Developing
- SQUAWK!™ U.S. Trademark Application Serial No.: 98948755
- You may not copy, modify, or distribute our intellectual property
- All app content, design, and code are protected by copyright
11. Termination & Bans
We reserve the right to:
- Suspend or terminate accounts for Terms violations
- Permanently ban users who demonstrate dangerous, malicious, or violent behavior
- Remove content without notice
- Refuse service to anyone at our discretion
You may delete your account at any time through app settings.
12. Disclaimer of Warranties
SQUAWK!™ is provided "AS IS" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Message delivery or notification success
- Accuracy of location data
- Availability during network outages or disasters
13. Limitation of Liability
To the maximum extent permitted by law, Beakin Network Developing shall not be liable for:
- Indirect, incidental, or consequential damages
- Lost profits, data, or cryptocurrency
- Damages resulting from service interruption
- Actions of other users
- Failed emergency alerts or delayed notifications
14. Indemnification
You agree to indemnify and hold harmless Beakin Network Developing from any claims, damages, or expenses arising from your use of SQUAWK!™ or violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved in the courts of New York.
16. Changes to Terms
We may modify these Terms at any time. Significant changes will be announced in-app. Continued use after changes constitutes acceptance of the new Terms.
